Terms of Service – Diode Laser Germany

These Terms of Service govern your use of our website diodenlasergermany.de and any purchases, services, or transactions conducted through Timeless Glanz. By accessing our website or purchasing equipment, you agree to these terms.

1. General Terms

These Terms of Service constitute a legally binding agreement between you (the "Customer") and Timeless Glanz, operating as Diode Laser Germany (the "Company"). By using our website, purchasing equipment, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

2. Equipment Sales & Purchase

2.1 Product Information

All equipment specifications, descriptions, and images are provided for informational purposes. While we strive for accuracy, specifications may vary slightly from those displayed. Technical specifications are subject to manufacturer updates.

2.2 Pricing & Payment

Prices are displayed in Euros (EUR) and include applicable German VAT unless otherwise stated. Prices are subject to change without notice. Payment is due upon order confirmation unless alternative payment arrangements have been agreed in writing.

2.3 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order. Order confirmation via email constitutes acceptance. Equipment availability is subject to stock levels and manufacturer supply.

3. Delivery & Installation

3.1 Delivery Terms

Delivery times are estimates and not guaranteed. We will make reasonable efforts to deliver within stated timeframes. Delivery is completed when equipment is transferred to the carrier or customer's designated location.

3.2 Installation Services

Professional installation services are available upon request. Installation costs are separate from equipment purchase unless explicitly included. Customer must provide suitable facilities, electrical connections, and access as required.

3.3 Risk of Loss

Risk of loss transfers to customer upon delivery. Customer is responsible for inspecting equipment upon receipt and reporting any damage within 48 hours.

4. Warranty & Returns

4.1 Manufacturer Warranty

All equipment is covered by manufacturer warranty as specified in product documentation. Warranty terms, duration, and coverage are detailed in our Warranty Policy. Standard warranty period is 24 months from delivery date.

4.2 Return Policy

Returns are accepted within 14 days of delivery for unused equipment in original packaging. Customer bears return shipping costs unless equipment is defective. Restocking fee of 15% may apply to returns. Custom-ordered equipment is non-returnable.

4.3 Warranty Exclusions

Warranty does not cover damage from misuse, unauthorized modifications, improper maintenance, or operation outside specified parameters. Regular maintenance as outlined in equipment documentation is required to maintain warranty validity.

5. Service & Maintenance

5.1 Service Agreements

We offer maintenance and repair services for equipment purchased through our company. Service terms, pricing, and scheduling are detailed on our Service & Support page. Service contracts are available for ongoing maintenance needs.

5.2 Repair Services

Repair services are provided on a time and materials basis unless covered under warranty. Repair estimates will be provided before work commences. Customer authorization is required for repairs exceeding estimated costs.

5.3 Parts & Accessories

Replacement parts and accessories are available through our service department. Only manufacturer-approved parts should be used to maintain equipment performance and warranty coverage.

6. Training & Certification

6.1 Training Programs

Professional training programs are available for equipment operation, safety protocols, and treatment techniques. Training enrollment, scheduling, and costs are detailed on our Service & Support page.

6.2 Certification Requirements

Equipment operation requires appropriate professional certification as mandated by German law. Customers are responsible for ensuring operators possess required qualifications and certifications.

6.3 Training Materials

Training materials provided are for educational purposes and remain Company intellectual property. Materials may not be reproduced, distributed, or used for commercial training without written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Company liability is limited to the purchase price of equipment or services. We are not liable for indirect, incidental, consequential, or special damages including lost profits, business interruption, or data loss.

Customer assumes all risks associated with equipment operation. Company is not liable for treatment outcomes, client injuries, or professional practice consequences.

8. Intellectual Property

All website content, trademarks, logos, and proprietary information are Company or licensor property. Customers receive no intellectual property rights except as explicitly granted. Unauthorized use of Company intellectual property is prohibited.

9. Regulatory Compliance

Customer is responsible for obtaining all required licenses, permits, and authorizations for equipment operation in their jurisdiction. Customer must comply with all applicable radiation safety, medical device, and professional practice regulations.

Company provides equipment documentation and certifications but does not guarantee compliance with jurisdiction-specific requirements beyond German standards.

10. Termination

We reserve the right to refuse service, cancel orders, or terminate relationships with customers who violate these terms, engage in fraudulent activity, or misuse equipment. Termination does not affect warranty obligations for equipment already delivered.

11. Governing Law & Disputes

These Terms are governed by German law. Disputes shall be resolved through German courts with jurisdiction in Darmstadt. Both parties agree to attempt good-faith resolution before initiating legal proceedings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to the website. Continued use after modifications constitutes acceptance of updated terms. Material changes will be communicated via email to registered customers.
